Q: am I liable for Towing and storage fees in an accident that was not my fault?
I was involved in an accident where the other driver received a citation for failure to yield. My vehicle was damaged in the crash and towed to a wrecking. I was informed by the other parties insurance company that I need to have my vehicle towed out of the yard 2 minimize storage fees and that I am responsible for those fees.
A: If the other party, via their insurance, is responsible for repairing your vehicle, it would seem that they are also responsible for the towing. Ask them why they don't believe they should pay this charge.
A:
Most states say that the insurance company is responsible for promptly and fairly resolving damage cases. if it's a total loss you'll want it towed to whoever you want to have fix it. You aren't responsible for tows--they are. Suggest you call them, say you want to clarify their position. Write each item you believe they have said down in order, then ask them is that their position on each one. If they ask why tell them you believe they are unreasonable and if there's a problem you want to be sure that you understood them. Send them a confirming letter.
However, more importantly, if you were hurt you can get a free consult from a member of the Fla.Assn for Justice. Why not get one.Clearly this company is going to try to nickel and dime you on everything.
