Q: if somebody violates a ppo and gets arrested, I will have to go to court to prove that he is wrong?

i have a ppo out against my husband for no contact with me or the kids. if he gets arrested for violating it and gets a court date, do i have to go and prove that he is wrong? do i have to prove why he violated the ppo? or why the ppo was put out in the first place? if the judge favors on my husband side and drops the ppo do the crimal charges fall on me then?

A: Your husband had 14 days after he was served with the PPO to dispute it. If he did not dispute it the order is effective until it expires. If he later violates he cannot dispute it. And yes if he violates absent a plea deal you would have to testify.
