Q: My Dad came back from rehab with a bed sore and it's taken months to heal. Can we sue the place for neglect?
A: If the bed sore was caused or arose while your dad was rehabbing at this facility, he may have a good cause of action for negligence. I would encourage you to photograph the wound and to be sure that your dad is receiving medical care given the dangers of an open would has to infection. I assume he may be on oral antibiotics already. Some individuals who have other medical issues such as diabetes, kidney function disorders are very slow healers. The Illinois Nursing Home Care Act is designed to protect the rights of those who have been neglected, abused, etc. at Illinois nursing homes and long and short-term facilities. I cannot be certain that the facility your father rehabbed at would be one of the type of facility the act was designed to include. The Nursing Home Care Act allows nursing home residents a private statutory cause of action for actual damages and costs.
