Consider it mine as we shared a home and expenses. His son believes he should have that money and is threatening me daily. Can he have me brought up on charges like he's threatening and will I have to give him that money? My roommate suffered a heart attack and died one week later. During that last week we discussed what I should do should he pass. The heart attack gave us reason to have wills drawn up and we're gonna do so as soon as he gained back a little strength but he passed one week after the heart attack so we weren't able to do that. Can his son have me brought up on charges or do I have to give his son that money it was 300 dollars total. I was given the pin number and was told I should take it should he pass away because we lived together and shared expenses . His son hasn't had contact with him and only got in touch with me to see what there was of any value and to threaten me about withdrawing that money from the bank. Thank you for your time
A: If you were not a joint owner of the account, or if you were not named as the beneficiary of the account upon the death of the account holder, then the money is not yours and you must return it to the Personal Representative of the Estate. You should make a claim against the estate for your deceased roommate's share of the expenses that accrued while he was alive. If there are on-going expenses after your roommate's death, those may be expenses of estate administration that are also subject to reimbursement.
