Q: My spouse was killed by a person running a red light.

The person didn't get jail time but I know he has a one million dollar insurance policy -- can I sue him to get that full amount?

A: I am sorry for your loss. But yes you can sue, there are numerous issues that need to be vetted first. I strongly suggest you contact an attorney.

A: Yes, you absolutely can. Whether or not the driver got jail time is not determinative. Have you made any statements to any parties or insurance companies involved? It would be in your best interest to refrain from speaking to anyone about the collision, and consult with an attorney individually immediately. A knowledgeable attorney will review the specific facts of your case, and advise you as to your options moving forward. I apologize for your loss, and hope will find counsel that can work tirelessly to get you the recovery you deserve.
