Q: Got a ticket for illegal transportation of alcohol as a passenger, 11-502b in Normal IL. Can I keep it off my record?

The McLean County Clerk said it would result in 0 points on my driving record. Can I get supervision without appearing in court? Will this negatively effect my insurance? I am 22 years old, and was visiting campus. I currently live 150 miles away and just started a new job. I am trying to avoid my insurance rates going up and taking a day off of work if possible. Thanks for the help!

Honestly, I cannot say with absolute certainty. What I can say is that in general, supervision will prevent an offense from appearing on your public record (the one employers and insurance companies can see). This however gets less certain when it relates to DUI related offenses. I don't know transportation of alcohol would count as one which would appear on the convictions page of the driving record. You can call the Secretary of State and ask them. They can be reached by dialing (800) 252-8980, then pressing 1, 7, 6, and 3 and each subsequent automated menu. I would recommend asking if that offense would "appear as a type action 55 on the convictions page the way a type 55 action for a DUI would appear". That is the technical way to ask it. Type action 55 is code for supervision.

As for appearing in court, you may be able to have an attorney appear for you to increase your chances of court supervision. If they are requiring a court appearance, this may be a way to avoid it.

Lastly, you should ignore what the clerk stated. The Secretary of State doesn't use points in that way. Instead, they go off of the number of moving violation offenses within a year.

A: If the Secretary of State states that this offense would appear on the convictions page as a type 55 action, then yes, it would be visible to insurance companies. If the Secretary of State says it will NOT appear on the convictions page but rather will appear on the supervision page as a type action 55, then your insurance company will not be able to see it if you get supervision.
