Q: I just received a ticket for talking on the phone while driving.
On the ticket the Officer checked a box that says my license is a CDL. My license is not a CDL, but rather a class D license which is also noted on the ticket. Is this still a valid ticket?

Yes, this is a valid ticket. Errors on tickets are rather routine in our line of work and the law accounts for this. A prosecutor may make amendments to a ticket which would allow this change to be made anytime prior to trial. The only way a ticket like this would potentially undermine the case is if the ticket called into question the identity of the driver. A clerical error like notating that it was a CDL is unlikely to have this impact.
WITH THAT BEING SAID, you should be aware that if this ticket is not changed to reflect this, it may make supervision for this offense appear on your public record. CDL drivers have different rules for supervision that requires them to make supervision public knowledge. This can raise your insurance rates if the ticket notates you have a CDL. As such, it is advised that you go to court, bring your license, and have the court correct the error.
