Q: quistion on custody

my wif and i seperated about 7 years ago we want to try again but in the time she has been gone she has had another child and she has some sort of court agreement that if she leaves the guy she cannot go more than 300 miles from him i like more like 3000 miles from him but he is dangerous and just laving him or trying to get the court stuff changes we feel puts her in danger if she was to move here with the child would she be charged with more than contempt of court being as she has custody and the birth certificate

A: What you are describing doesn't make a whole lot of sense because in the first place if you ahve been married during this entire time, under Oregon Law you would be presumed to be the father of the child although there are exceptions. I can only imagine what a long convoluted set of court records there must be to have your wife be under a court order regarding the custody of her child fathered by another man while she was still married to you. You are simply going to have to gather up a complete set of the court records for all court proceedings relevant to your marriage and this child, even if this involves more than one case, different courts, and different States, and take the court records to an attorney and figure out what is going on.
