Q: I want to move out of the state of Florida with my 15 month old daughter. Can I do that without telling the father?

We are not married or going through a divorce.

A: Since you are not married to the father of your daughter, then by default you have all the right to your child and as such may move without permission from and notice to the father. However, if the father files an action for paternity within 6 months of your move, you may be ordered to return the child back to Florida.

A: Is the father aware that he has a child? Is he involved in the child's life at all? I am assuming by your email that you are not married to the father, so has he registered in any way as the father - on birth certificate or otherwise?

The general answer to your question is no....there is a court procedure that must be followed. However, many factors go in to this situation.
