Q: Will support I receive for my child in Pa. be lower if I'm the custodial parent & now disabled w lower income?
The case resides in pa both of our incomes are used in calculation of our daughters support. Will his monthly obligation be lower if our combined total is lower but due to my disability. I am unable to work. My daughter and I live in NY...father is in pa & has no visitation with her. I also pay for her health insurance
A: Child support is calculated based on the combined monthly income of the parties and then a guideline is used to determine the appropriate amount of support. The guideline tells the parties what the support amount is then that is proportionally split between the parties based on his/her income. If there is a substantial change in circumstances then that would likely warrant a modification of the child support obligation. The Father's support obligation may go up based on the change in circumstances. Contact a local attorney to determine whether or not you should proceed with a petition to modify at this time.
