Asked in Workers' Compensation for Illinois

Q: Why would Worker's Comp refused to pay for an FCE even though my Dr. asked for it??

I hurt my back in March 2016. Its now 8 months later and I'm still experiencing some pain. I have had epidural shots, physical therapy and just completed 4 weeks of a work hardening therapy program. My dr. ordered an FCE to be done before my next visit in 2weeks. Everything was schedule and ready to go until the day before I get a call that workers comp refused to pay for the FCE!! Why all of a sudden would they refuse this important test? Also my dr. ordered this so what should I do?

A: You should hire an attorney immediately. This is unfortunately a very common occurrence when claimants are not represented by counsel, the insurance company attempts to take advantage of you. It is certainly in your best interest to have an attorney represent you in these situations, as there are several arguments to be made to have them pay for the FCE and more. Have you received temporary wage loss, or TTD since your injury? In any event, organize all information pertaining to this claim, including any correspondences with the insurance company, and consult with an attorney immediately. A knowledgeable attorney will review the details of your specific case, and assist you in all aspects of the recovery process. In addition, the IWCC mandates attorneys work on a 20% contingency, so attorneys will only get paid if you recover, and will save you time, money, and stress. Many of us offer free consultations, so it will not cost you anything to obtain a personalized, and professional opinion.
