Q: Should I sue for damages in an auto accident that I was not at fault and their ins. has denied claim.
I was rear ended in an auto accident. The driver of the other vehicle did not own the car he was driving. The owner of the vehicle has insurance but does not feel responsible for damage to my truck. I have filed a claim with her insurance company, they denied the claim because they cannot get in contact with the owner.. the owner will not respond to her insurance co. or talk to my insurance.. the accident happened in Virginia near Danville.. I am a resident of NC
A: Do not give up. An attorney can assist you with your claim. If the claim has actually been denied, as opposed to delayed in being accepted, you need to make sure your own insurance carrier has been notified of a possible uninsured motorist claim.
A: If you have collision run it through your company--they will go after him and his company. You have an injury claim if you were hurt. Contact a member of the NC Advocates for Justice--they give free consults.
