Q: I received a first time offense DUI in Georgia in 7 years ago but now cant get a commercial drivers license?
I paid my court fees and moved to Virginia and got a Class E license, and then moved to Florida and got a Class E license. I tried to get a CDL Class B license in Florida and they said that Georgia has a block on me and they cannot issue the CDL license.
Georgia says that I must complete the DDS course and mail them a certificate and pay $200 for a license reinstatement.
Why would I be able to get a normal drivers license but not a CDL license in a different state, and why would I be required to pay a reinstatement fee for a license in a state I no longer live in? This was 7 years ago that I got that DUI, and have had no other offenses since, isnt there a time period where this should no longer be an issue?
I was in the military when this happened and they made me complete a drug and alcohol abuse program internally, would that be satisfactory for Georgia?
A:
You will NOT be permitted to get a CDL ANYWHERE in America, until you clear up Georgia. It is that simple. The federal government has worked for decades to stop people who have license issues in ONE state from moving to another state and starting over. It is part of the Interstate Compact (agreement) between all states.
However, that problem is not that big of a deal, in light of the money hat can be made as a CMV driver. You have remained suspended in Georgia all this time, due to not reinstating. Until you reinstate, you can NEVER drive in Georgia again! That impediment is pretty important to a commercial trucker who almost HAS to drive in or through Georgia, if you live in Florida.
You can take the Florida Level 1 course, and pay the fee by mail, and be done with it. This information is on the Georgia DDS website:
The DDS will accept DUI Alcohol/ Drug Use Risk Reduction Course certificates of completion from Florida residents as follows:
First time DUI Offenders: Level I, 12 hours
Multiple DUI Offenders: Level II, 21 hours
Course Provider must be certified by the state of Florida.
No online courses are accepted.
Different courses may be taken to accumulate required number of hours.
Certificate of completion on approved school/agency letterhead must be obtained and submitted to the DDS. The certificate must include the following:
Name, address, and phone number of school/agency
Type of program and completion date
Total number of course hours completed
Customer name and Date of Birth (Driver’s License number is helpful but not required)
For U.S. Military offered programs, certificates will be accepted for active duty U.S. Military personnel ONLY. Certificates for dependents, spouses, retirees, or Veterans will not be accepted.
To locate a certified course provider, contact the Florida DMV or reference the Yellow Pages or online search engine for DUI, Risk Reduction, or Substance Abuse.
