Q: Should I sue my neighbor for damaging my fence by blowing his snow into my yard or should I file an insurance claim
I have asked them several times to stop because it has damaged my fence they ignore me. I have photos and video of them blowing the snow in my yard and the damage they caused. I have replaced plants & the grass in my yard. They even drove through their fence in the backyard driving over my plants police did nothing. The broken chain link fence is being held up with 2x4's for 1 1/2 yrs now. I have 2 sm. grand children now and do not trust this guy as he is a hot head. I need to fix property to sell. It's not his house its his mothers and her complaint is my leaves blow in her yard. We live in a tree infested neighborhood and mother nature does that not me. Unlike her son, her and her 2 adult grandsons damaging and purposely throwing snow on my property. When their father was alive never had a problem. He passed and they wont stop. They think they have the right to do what they want. He has every means to remove the snow and place elsewhere on his property (snow blower, plow and shovel)
A: I understand your frustration. The answer to your question depends on personal preference and the amount of damage that has been done to your property. What would you estimate the damage amount as being? In addition, your insurance may or may not cover such intentional acts. The other factor to take into consideration is creating an even more hostile relationship with your neighbor if you file a lawsuit against them. At the same time, it seems like you may want to send a message to prove to them they cannot do whatever they wish. I would recommend organizing your homeowner's insurance policy, and consulting with an attorney individually. Many of us offer free consultations, so it will not cost you anything to obtain a professional opinion tailored to your specific needs.
