Q: In rental car I am covered w/my insurance. I yielded at a 3way stp but got broadsided, no tickets but I got a warning.

I was in TN on vacation with my family in a rental mini van. We were at a 4-way intersection but a 3-way stop but the stop sign only said STOP, it did not have a 3-way tag below the sign. I stopped for 30-45 seconds waiting to see who would go, no one was going at-all and no traffic was flowing through the intersection. To me, this seemed like a 4-way stop. I proceeded as to me, I was next up, I made it through then was broadsided by a car traveling through the intersection via the side that had no stop. I was not cited and neither was he, I did get a warning though. There were no injuries at the scene. I read that the Right of Way transfers to the vehicle in the Right of Way and the approaching car now has to yield to the car in the road in front of him. He should have been able to stop. I want to give the rental car co. his insurance co to pay but the report shows I got a ticket even though it was a warning and he got no ticket. I thought TN if you hit a car, you got a ticket.

A: In no place that I know of is there an automatic rule about tickets.

Not sure what the problem is. The rental car insurance would pay and only question is is it chargeable to you or is there a deductible.

Focus on where the other car hit. If you had full position should have been toward your rear panel. Question is why didn't you see him. These are all issues you are better off workshopping with someone else.

Also get the full police report--you may only have an abbreviated version.
