Asked in Patents (Intellectual Property) for New York

Q: Dear Lawyers, I would like to know whether the Oso Aluminium Barbell Collar has a patent on the design and form. Thanks.

Dear Lawyers,

I would like to know whether the Oso Aluminium Barbell Collar has a patent on the design and form.

It doesn't state it on their website or elsewhere. But I'm still not sure. I also wasn't able to find anything on a quick google patent search. Are there any clues on how to find out whether the barbell collar is patented?

Thanks.

A: If you have one of these Barbell Collars, take a careful look at it. There should be something like "U.S. Patent 0,000,000", or "pat. pend." or something similar. If there is nothing there, take a look at the packaging for these markings.

If there is no such marking, and nothing about patents appears on Oso's website, then it looks like that there is no patent that the company wants to enforce.

Also, a brief search of patent assignment shows that no patent has been assigned to Oso Barbell Clamps or similar entities.

https://assignment.uspto.gov/patent/index.html#/patent/search/result?id=oso&type=patAssigneeName , and patents that are assigned to various entities with "Oso" in their name don't have anything to do with barbell collars.

Obviously, you may want to check this out by a patent attorney that you've actually hired who can look into this matter deeper, but based on just what you said it looks promising to you.

Good luck!
