Q: Can I get my Illinois Drivers License suspended for only 2 traffic violation within 12months?

The violations are almost a year apart. First one occured 1-8-16 and was convicted on 1-27-16. It was for disregarding stop sign at intersection. The second one occured 12-11-16 and was convicted 01-03-17. It was for speeding 15-25mph above limit. It clearly states on the dmv website that the SOS can suspended your lisence for THREE moving violations with 12 months.

The answer is yes and no. Yes, you can in this situation but only if you were under 21 when you received BOTH tickets and BOTH were within 24 months of each other and BOTH resulted in a conviction (as opposed to supervision or dismissal). In that situation, moving violations can result in a suspension after only two offenses. Additionally, if you have had a prior suspension under 21 for moving violations and receive even one moving violation before turning 21 that leads to a conviction, you can be suspended for 6 months.

If you were 21 or older when you got the tickets, generally speaking, you should be ok. I say generally because there are certain violations that on their own can trigger a suspension. Insurance violations, street racing, driving without valid licenses, and scott's law violations just to name a few. In these situations, one is enough. None of the two offenses themselves can trigger a suspension assuming nothing like an auto accident occurred in tandem with them if you are 21 or older when you received them.

With that said, you would be best served appearing in court for the second ticket if you want court supervision. Court supervision is routinely denied by mail if you had a ticket in the last year. So, if you want something better than a conviction, expect to go to court or have an attorney appear for you in court. Though based upon your description of "15-25 mph", it sounds like you are reading this off a driving record rather than a court docket so it looks like it is already on your record. If you did want to remove one of these violations to clean up your record for insurance and license preservation purposes, you can do so by filing a motion. An attorney can also assist in this matter.
