Asked in Criminal Law and Domestic Violence for Tennessee

Q: I was forced into a plea bargain. I was not given any disclosure. The deputies affidavit was totally incorrect.

Upon reading his affidavit it became obvious that the deputy did not take notes and that his statement was not a true reflection of events.

Had I had disclosure then I would of vigorously defended myself however I was forced into a plea bargain. How can I be exonerated of this matter.

This matter took place in Tennessee and I was convicted of TCA 39-13-111 my wife did not press charges and it is based solely on the deputy's sole incorrect statement. Can you help please.

A: Were you represented by counsel? Did you have a preliminary hearing? In what court did you take the plea (circuit or general sessions)? Facts matter. You should consult an attorney asap. But in all likelihood there's probably not much that can be done since you took a plea.
