Q: My 17 year old daughter was under the home supervision of the New Jersey Intensive Supervision Program.

During the almost weekly administered drug tests during the first 9 months she was declared to be drug-free although she was using heroin the entire time. On several occasion we, her parents, determined her to be high on a non-alcoholic substance and requested her JISP officer to come administer a test. None of those tests produced positive results. Eventually my daughter was arrested twice in a one-week period, and charged with Poss of heroin and paraphernalia. Even after our persistence to the JISP Officer that something was amiss with the drug testing he continued to assure us that she was drug free. As parents we relied on their expertise and reluctantly believed she was not using any illicit drugs. Had our concerns been adequately addressed on day one she would not have needed an extensive drug treatment program and been sentenced to one year incarceration due to her violation of probation. Does the JISP program share at least some liability?
