Q: What should I do if my ex-wife has been doing dugs in front of my son and has a boyfriend that is a criminal absconded?

I am the primary custodial parent in Alaska and my Ex-wife lives out of state. She has summer visitations. She has a history of custodial interference and demestic violence. The last time we went to court I received new paperwork added to our parenting plan. The new modification added that my ex-wife was to provide me with her address immediately if she were to move. She was living in Hawaii and was evicted which I have the court dockets to prove she was evicted. She said she was going to move to a different state May 2016. It is now February 2017 and she has refused to provide me with a new address. She refused to buy plane tickets for summer visitation which she must purchase per the court order if she wants summer visitation. My son has told me during his last visit with his mother his mother drank heavily and smoked pot in front him daily. I tried to report it to the police but the police will not do anything about it. She has a boyfriend with a long criminal history violence& drug

A: Sounds like you have two issues which can be separated. If you think your ex-wife's home is unsafe, and can find enough solid evidence to back up your concern, then you may want to file a Motion to Modify your custody order.

Her failure to buy tickets and to give you her new address seems to fall within your current order. If she isn't complying with the prerequisites for a summer visit, then you should file a Notice with the court that you intend to forgo the summer visit unless she fulfills her obligation by a given date. Be sure to serve her with the Notice at her address of record, and at any other address you know about. That puts the ball in her court, and if she takes no action, then she can't complain later about you denying her visit without cause.
