Q: When I was 16 I got a 35 over ticket, I thought it was supposed to be removed when I turned 18, but it didn't.

When I was 16 I got a 35 over ticket, I thought it was supposed to be removed when I turned 18, but it didn't. I am now 19 years old and it is causing in insurance issue at my new job and they needed to be removed, how do I go about this?

A: Hello Asker,

Regrettably, this is not the case. Traffic violations are not removable based upon one's age. Even when court supervision is granted, evidence of some form will still remain on your record to, at a minimum, help the court determine your eligibility for future court supervisions. In this case, your ticket will stay on your record unless action is taken to remove it from the record. At this time, you are technically beyond the legal time frame for modifying older cases (within 2 years). That said, an attorney can make the argument to request the prosecution grant you the opportunity to modify your record due to your misunderstanding of the law.

My recommendation would be to call an attorney as soon as possible as you are already beyond the 2 year limit. The sooner you get it back into court, the sooner you have a chance of seeing it modified. With that said, I cannot say how likely a modification will be. If your ticket was in Will County, it is unlikely that the court will do much for you. Other counties may have better luck. Either way, an attorney will be your best bet to review this and give you a straightforward answer.
