Q: Earlier today i was in the car with my mom. She went on the yellow stripes. Wil the warning stay forever on her licence?
A:
Hello Asker,
Let me first preface this by stating that I cannot fully verify these claims. These are based on conversations with others about how warnings are used but I can say that I feel that this is likely how warnings would work in this situation based on my ancillary knowledge of traffic law practice.
A warning is not a violation under the law and thus is not an offense which will likely harm her. My understanding is that their purpose is to monitor the level of leniency that they have given to drivers in the past. In my conversations with officers, I have learned that it varies from department to department and that these warnings don't really have a time limit. For most practical purposes, it is unlikely that these will affect her unless she is stopped by the same department in the future and they have retained the original warning from that time. Absent this situation, I doubt it will affect her in any meaningful way as they are not recorded to driving records (insurance companies use these to raise rates) and they aren't on any statewide databases that I am aware of (this would allow departments to share warning records with each other).
Hope that helps and let me know if you have any questions!
Sincerely,
Jason A. Wilkins
