A: If the court has not yet approved of the agreement you signed, you still have time to withdraw your consent. You will need to act immediately to preserve or restore your custodial rights, so you should contact an attorney right away. Ultimately, the court will award custody based upon the best interests of the child. In making that determination, the court usually prefers to leave the child in the custody of the child's primary caregiver. Other important factors the court considers in deciding custody include each parent's willingness to encourage and facilitate a relationship between the child and the other parent, and whether one parent has abused the other.
