Q: Can I start an I online store for my friend who's incarcerated and have everything in his name even though he's gone?

My friend would like for the business to be his and in his name if possible even though he's only done research and that's it. He want to give me power of attorney to carry his plans out. Is this possible? If not what can we do?

A: Being incarcerated does not disqualify a person from owning property or having a business. It can make the impractical to manage the business. A power of attorney may only cover a portion of the process as a power of attorney grants an individual the ability to perform acts on behalf of another individual. Once the business is set up your ability to manage the business may need to be through a different legal method: ie: as a manager or officer of the business.
