Q: In July my husband slipped and fell at a friend's home. Should we sue their homeowners?

He broke his leg in 3 places, had surgery and months of physical therapy. He also missed 4 weeks of work in which he was only paid 60% for one of those weeks. The medical bills are piling up and we can't afford to pay them. My "friend" never made the claim so I'm left in this uncomfortable situation. But they have been avoiding us ever since like they are scared we are going to ask about it. I don't know what we should do. He's still in therapy 8 months later.

A: The question in Louisiana is whether your friends were negligent and whether that negligence was a cause in fact of your husband falling. In Louisiana, one must prove that there was a defect (or problem) that caused your husband to fall, that your friend knew (or should have known) about the problem, and that the problem was a cause in fact of his accident.
