Littleton, CO asked in Contracts and Real Estate Law for Colorado

Q: I am under contract with a builder and the executed contract states in an addendum "Seller agrees that Purchaser will

option to reconfigure the laudry room layout to accommodate a have the option to reconfigure the laundry room layout to accommodate a half bath. Additionally, the seller agrees to explore the possibility of a three quarter bath, but Seller makes no representation that it is a possible design confiuration for the space."

If the Seller is now stating that

they "will agree to laundry room ayout to accommodate a half bath per the contract. We have explored the possiblity of of a three quarter bath and have determined that it is too much a deviation in floor plan for us to allow this change to occur."

We provided an architecural dimensioned plan that allows for such a change and provided the design configuration for the change. Aren't they legally bound per the signed contract to make the change?

Additionally, since it does not indicate who should pay for it, is it at the Seller's expense?

Thank you so much,

Stephanie
