Q: Did not get proper representation. I developed asthma as did a co-worker. She did not file a claim against the company.

The lawyer I had did not consult me for information. Maintenance worker,painters could have been called to support my claim as to the mold and mildew in the office where I worked. We had to fill out requisitions whenever we called them to mop up water from the leaking roof. They had to use large fans to dry closet where we kept our records. I worked as an MDS coordinator. This is an injustice that should not have happened if the lawyer I had did his job. I am representing myself. Unable to get the information that is part of the company's record. What do I do? If the lawyer had done his job I would not be in this situation If the arbitrator rules in the company's favor I plan to take this to the commissioner.

A: It is very difficult to prove causation in mold cases because the results (asthma etc) can happen without mold contamination. You may think it's open and shut,but with the law, you sometimes have to prove that the sky is blue!

Why not get a consult from another attorney who focuses their practice on workers compensation cases.
