Q: I was terminated while off on an injury. Could they do that ?
in 2010 I slipped off of truck that I was working on. I went to their Dr. for a year and he could not fix the problem in my lower back. Towards the end of the year I decided to find help.
The new Dr. sent me for a test (milagram) and threw that test he found a pinched nerve! I had an operation ( Laminectomy)in 2010. After that I am seeing a Pain Consulted and a return back to work on light duty Dr.'s note but, my employer would not accommodate. now no longer receiving work workers comp. that stopped last Feb 2016 and then getting a letter at the end of June saying that my job subscription was eliminated 2013 I needed to come and talk to them. I didn't want to go alone, In mid July I received a letter that stated "I was Terminated"
A: The answer to your question depends on a variety of factors that are not provided here. That said, Illinois is an employment at will state, so an Illinois employer can terminate an employee for nearly any reason, or no reason at all, so long as the reason is not an illegal one, such as being a member of a protected class (i.e. race, age, gender etc.). You may have an action for retaliation of your worker's comp claim, but your employer could have a multitude of other reasons for terminating you. In any event, I would recommend organizing all information relevant to this situation, including a detailed timeline of all relevant events, and consult with an attorney individually.
