Q: My fiance was recently arrested for a misdemeanor domestic assault

I did not want to press charges however the state of Illinois picked it up anyway I have also been subpoenaed to appear in court I do not want to do this either what is the worst that can happen there are two children that live in the household that are not legally mine they are his I'm afraid that he will be arrested again is this possible he is the Sole Provider of our household I was told by the state's attorney that this will not happen but as I know it is their job to convict and they really don't care about me or my children I need to know what is the worst that can happen I'm very frightened and now wishing I never had called the police in the first place I only called to prevent things from escalating and now they've escalated into this circus which to me is a ploy for the state of Illinois to get money from me and my fiance

A: If you don't appear in court, then they can file a contempt petition against you or get a warrant out for your arrest. As a victim, you can hire your own attorney if you'd like and see if they can speak to the assistant state's attorney on your behalf.
