Q: In a court ordered parenting plan is the time stated for transition mean she is to be in our care prior to that time?
I am currently in a custody battle over my step daughter. We have a court ordered parenting plan stating that we have he from Sunday at 4pm- Thursday at 7pm. Her mother is constantly showing up to the transition site at 3:30-3:40 and with holding the child from 1-20 minuets after 4pm. Is there anything we can do about this? Is this violating the parenting plan?
A: "Transition site" = what does that mean? Is this like a McDonalds where mom wants daughter to finish eating before leaving with you? Without knowing the reason for the delay it is hard to comment. "Constantly" - what does that mean? If you are involved in a pending court situation this has not been going on for years and years, probably just a few months while your court proceeding is pending. If the parenting time is court ordered, then you can file a petition to enforce parenting time and get a judge to explain to mom what she can and can't do. If you have an attorney representing you I would discuss this with your attorney first. If there is something going on at the pick up location that is causing the delay, then consider changing the pick up location.
