Q: Are car accident police report admissble in the small claim court ?
I had an accident last december when someone hit me from the back ... passenger side when the police came they gave him a ticket for carless driving but his inssurance don t wanna pay for my damage i went to the small claim court but i m so worry because he has a lawyer when i don t have money to hire one
A: Yes a police report is admissible and it sounds like it would be very helpful. Going against an attorney when you are not an attorney is scary, but don't focus on the attorney. Work on building your case (e.g. what damage occurred?, how did the accident occur?, What evidence do you have to support your claims?). You can also work to counter the lawyer's argument (by now you should have an idea what the other party is going to say - maybe contributory negligence/joint fault?). Judges (especially in small claims) tend to give unrepresented parties a little more leeway than lawyers. Lastly, there are several NOLO books (which should be available at your local library) that assist non-lawyers with filing and arguing their cases in court.
