Q: I got off court supervision earlier this month and just got a speeding ticket will I lose my license?
A:
Hello Asker,
It's hard to say. In absence of a driving record and your age, I cannot say. What I can say is that there are a few moving parts to your question. First, court supervision is a system that avoids convictions on your record. For most intents and purposes, supervision prevents an offense from harming your license. While there are exceptions to this rule such as tickets related to alcohol received when one is under 21 or insurance violations, the general rule is that receiving supervision prevents it from harming your license. During the supervision period, you are required to not receive tickets or violations of the law, comply with all other terms of your sentence, and if necessary, reappear in court at a predetermined date. Assuming this is accomplished successfully, an order of court supervision is said to terminate satisfactorily. In practice, this means that future violations will not alter how that offense affects your record.
With that said, receiving a new ticket following your supervision termination date will not affect your prior supervision. As for the second ticket for speeding you now face, it is not possible to say what impact it will have without asking multiple follow-up questions in a phone consultation. In the worst case scenario, there is a high risk of suspension that borders of near certainty if your aren't supervision eligible for the new ticket and you have had a prior suspension for moving violations and all this occurred under the age of 21. In the best case scenario, you have a supervision eligible speeding ticket, are over the age of 21 when all this occurred, and had a satisfactorily terminated suspension in which case there is much less risk of suspension. While these describe specific circumstances, it's important to know the law surrounding license suspension is rather nuanced and without getting more information, I cannot say whether you are at high risk or low risk of suspension and to give a more accurate answer would require a phone consultation.
Hope that helps and let us know if you have any additional questions!
Sincerely,
Jason A. Wilkins
