Q: Should i file a petition to establish paternity before my hearing or request the petition during the hearing?

I have a upcoming hearing to terminate my rights on grounds of abandonment. im the biological father but not the father legally.

A: File as soon as possible.

A: If you oppose the termination of your parental rights, let the termination court know and you should be appointed an attorney if you cannot afford one. He or she can advise you. If you oppose and you are not appointed an attorney or can't afford one, you should file to establish paternity as soon as possible. Depending on what county you are in, you may be required to hire an attorney to help you. Often you can let the child support office know that you believe you are the biological father and want to be recognized as the legal father and they will arrange for DNA testing.
