A: Yes, it is very likely. A driver also faces a suspension at their arraignment, which is the first court appearance. This is called a pre-conviction suspension, and will apply if the BAC is .08% or higher. If there is a refusal, there will also be a suspension as well as a 1 year revocation as a result. Then, there are additional suspensions as a result of a conviction, even on a reduced offense. You should consult an experienced attorney in order to get further advice.

A: Your license will be suspended at the first court appearance under New York's mandatory prompt suspension law. You should retain counsel to minimize the damage as well as the license suspension.
