Q: I was pulled over by a police due to school zone speed limit. I was not given a violation ticket but a warning ticket.

Just want to ask how long will my warning ticket stay and is there an expiration or will it be erase within a certain period? Please help. Thanks. Odi

A: Hello Odi,

Unfortunately, I cannot say definitively. Warnings are in my experience handled on a department by department basis. They are not to the best of my knowledge reported to any agency that catalogs them the way speeding or other moving violations are. In my conversations with prosecutors, I have learned that they are generally used as a metric for determining how much leniency the officers give to a driver before writing a citation. For example, it is common for truck drivers to receive warnings because officers are hesitant to write a ticket which may harm their livelihood. After a trucker has been given a warning or two, the officer may feel more comfortable citing them with an actual ticket.

So, to answer your question, it is unclear how long each department keeps such records. It varies. As for its erasure, it depends on the department as well. With that said, I know of no record that records these warnings so for all intents and purposes, your record shouldn't reflect any of these warnings.
