Brownsburg, IN asked in Constitutional Law and Traffic Tickets for Indiana

Q: Can you be pulled over in your driveway if you never saw the police officer, they never had on their lights or sirens.

Here is the rundown, I was a block from my home and pulling up to a stop sign, as I was approaching the stop sign I turned on my signal made a complete stop. Before proceeding I looked down and saw I did not have my wallet, I proceeded to turn and then make a immediate right(I signaled there was well). I got back home, tuned my vehicle off got out of the car and as I closing the door I saw a police officer coming down the rundown road, he turned on his lights and pulled in my driveway. Told me to get back in my vehicle, I did, then he said to come to the rear of the car, I did. He ask if I knew why he pulled me over, no I said. He said I didn't signal 200 ft before the stop sign. I told him I was unaware. He then proceeded to question me about a case my husband is involved in, as I answered the best I could, he would tell me to stop lying. This went on for 20 minutes before he got frustrated with me and told me I was free to go inside my house. Is any part of that legal?

A: Legal? Yes. The cop apparently had a valid pretext for initiating the encounter. You had every right to refuse to answer his questions.
