Q: My association charged me for a paid assessment letter even though the sale did not go through

Last year I Had a contract to sell my townhouse but the potential buyers backed out last minute due to loan issues. The association provided me with a paid assessment letter and a charge of $300. But as the sale never went through, the fee was not paid as there was no closing. I rented my house for the last several months but after putting it up for sale again this year, the property finally sold. At closing my attorney and realtor noticed that the association were not only charging me for my new paid assessment letter but they also tagged on last years charge for the old paid assessment letter too. I contacted them and pleaded with them to waive the extra fee for the old transaction but they refused, stating that it was their policy without actually furnishing proof of anything in their policy pertaining to this backcharge.

I mean, what if I had held on to my townhouse for several more years, could they still back charge me for a failed transaction from years ago? Is this legal

A: Check the Association By-Laws.

If it's a big association, odds are they know what they are doing.
