Q: How do I find bank accounts I think my child's parent is trying to hide during a child suppprt/ parenting plan mod.

Going to court to have child suppprt amount adjusted. The other parent has not disclosed their employment on the uniform support declaration. It is a new job they started a couple months ago. Is not reflected on past taxes.

I also believe credit card accounts are not being disclosed.

The bank accounts submitted show no bills being paid from them. The other parents spouse works. I know this doesn't matter but i beleive they're on one account that all bills are paid from. Account submitted shows no bills being paid from it.

A: There are several ways to get information when involved with a legal matter. The best way to approach this is to consult with an attorney and discuss what methods will be the most efficient and economical. One method is to send a document called a request for production of documents and the request will contain a list of possible types of documents. You have to give the other side 30 days to fulfill the request normally. Then you set a date for a deposition and you question the person about the documents you received and about how the things you are trying to figure out, such as how they are paid and how they share expenses with their spouse, etc. If you already know of someone that would have documents that are relevant, such as the parent's employer, you could issue a Subpoena Ducas Tecum to the employer and have them produce payroll information, but that would also involve having a deposition event that you are asking them to appear for. There are complexities in doing discovery so I really think you need to hire an attorney to assist you.

On the other hand, if the support modification is being handled through the district attorney's office or the department of Justice, these agencies will have access to the quarterly payroll reports that are being filed by an employer and they can use this information in the support modification process. This can save you a lot of hassle and money.
