A: The insurance carrier has the right to accept or deny a workers' compensation claim. If you believe your injury should be covered, then you should seek legal counsel to assist you in filing the necessary legal documents to advance your case to a hearing before a judge of compensation claims. The law is very clear as to what injuries are covered and which are not and an attorney can help walk you through the process. Based on your question, and without seeing the denial form from the carrier and medical records to date, I cannot answer for you whether you have a right to worker's compensation for your injury or not. But again, seek legal counsel as soon as possible so that they can review the facts of your case and the documentation pertaining thereto. There is a statute of limitation on workers' compensation claims and thus I advise you reach out to an attorney next week and not wait. I wish you all the best.
