Denver, CO asked in Copyright and Patents (Intellectual Property) for Colorado

Q: I'm looking for the "Potty Rider" patent

The website is vague but says it has a US patent. I have a slimier design but need to be sure im not violating any patent laws

A: You can check the USPTO website. Be aware that the PTO may not list all pending patents.

A: I think that the Potty Rider is described and claimed in Patent 9,585,529.

With regards to your possible infringement, you really need to have some other difference from Potty Rider’s design than just how slim it is. Making something slimmer or fatter generally does not get a potential infringer around a patent. Whether the differences between your design and the claimed design are significant to get you out of the scope of the claims is something for a patent attorney to determine.

Good luck!
