Q: My 12 year old daughter lives with me and my wife wants to divorce me, can I get full custody of her?
We are currently separated, my oldest daughter lives with me. I have two other children that live with my wife. I wanted to know if my wife would get full custody of all my kids in the state of Colorado.
A: Custody of your children will be decided in accord with the best interest of the child(ren). You can get custody of your daughter if that is in her best interest. You should retain an attorney to help you get the best outcome.
A: Each case is going to be different and a lot more information is needed to assess your situation. Though the norm would be keeping kids together, there are cases in which one kid might live with one parent and one with another. The facts and circumstances of your situation will dictate what happens and most courts look at each child individually. You should consult with an attorney if you are looking for a more specific assessment. In sum, it's possible that you could have custody of your daughter and her the other kid(s).
