Q: I entered the the parking lot at a store. As I was pulling in a man quickly backed up striking my car his insurance
He has Allstate and the agent took my statement and told me it would be about a week to investigate. The man apologized and admitted fault. No police were called bc we were on Dollar General's parking lot. It's Friday now and this happened on Sunday and agent won't return my calls. I spoke with different agent, she looked my claim up and she found us both at fault bc I said I. Was moving. And I WAS moving towards the parking spot next to this man, when he quickly backed up hard, I stopped completely and laid on the horn. Other cars were behind me coming in to the parking lot...i had no where to go I was a sitting duck. He hit me so hard , my neck snapped back and to the side and I thought I was fine, but now I keep getting headaches and my neck and shoulders are killing me, but that day I thought I was fine. Help!!
A: You will need to hire an attorney and likely file a lawsuit. Make sure to take care of your medical needs. And if your car is in storage get it out. The storage lot will charge daily. Take pictures of your damage. Turn this into your carrier to get your car repaired. If Allstate has not looked at your car, send them a note saying you are going to have your car repaired and if they want to look at it first they need to as soon as possible. Also, check with the store. See if they have video. If not are there stores around the area that might.

Go to the store immediately and see if they have it on the outdoor security camera or if there is one on a neighboring building. You had the right of way as the party driving; other person was backing up and had a heightened duty.
