Asked in Real Estate Law for Illinois

Q: Who has ownership of home and property after both parents died without a will.

My biological Mother passed away first without a will. The property was in her name only. My step-father passed while I was overseas. My half-Sister, 2 Half-Brothers went to a lawyer thinking that they could get everything and have me sign papers giving everything to my younger Half-Sister. I refused saying this is wrong. The property was in Mom's name only and the home and garage and one trailer were owned by my Mom and Step-Dad. I am paying all property taxes to keep everything from being taken and sold by the state. Everything is paid for. My older Brother passed away in 1999. Who gets possession of the property and home, Garage and 1 trailer? Oh, The car that Mom and Dad had now belongs to my younger Half-Brother aftrr both parents had passed away and I do not know who forged Dad's name on the title to obtain the car. And everything that my siblings wanted, they took while I was overseas and that included gold and dimond rings. One Gold ring I purshased for Dad.

A: The house belongs to the mother. It will continue to belong to her until someone is authorized to sign her name to a deed.

Her heirs are her spouse and children.

Since husband was alive at time of her death, he gets one-half and children divide the other.

The husband's share will be given to his estate.
