Q: Our incomes have drastically changed since the support order in place over 4 years ago. How do I change the order?

Order was set in place 4 years ago and since then we have both changed jobs. How do I update the support order to reflect our changed incomes when he is unwilling to fill anything out or report his income? The order was set in place in CO, where I live with the kids 100% of the time, but he moved to OH and won't give me any work information.

A: You can file a motion to modify child support. That will require him to produce his income records.the court will set a new child support amount based on your respective incomes. That change can be retroactive to the date you filed the motion. You should retain an attorney to do this.

A: You do not have to have his cooperation to get your support order changed. You will need to file a motion to modify support pursuant to CRS 14-10-122 and go through all the procedures. As part of the process he will be required to provide financial information or will suffer the consequences of not doing so. Though he is in OH, the case still remains a CO case. You should consult with a family law attorney.
