Asked in Contracts and Real Estate Law for Tennessee

Q: What recourse for purchase of a home seller didn't even bother including a property disclosure AT ALL

I paid for inspection and seller met him and told him he was aware of a water problem but detailed how he would fix. After contract was signed and we moved in we have discovered what a horrific problem we face he dumped a bucket of dirt and left ..We plan to sue for recension of contract based on NON disclosure .Is this possible ? The estimates for fixing this are astronomical with no guarantee of which fix will do the job.Its criminal that we are 300000.00 in debt and facing repairing something at this level. Not only was it not on a disclosure form.We have discovered we were not even given the form PERIOD.We need help. There are other details of cover up related .we need guidance

A: If the issue was not disclosed, and the owner knew you may have a basis to sue to rescind and or damages. I am also concerned as to whether this was revealed on your home inspection report. If your home inspector didn't discolse this may be an issue. Also, there may be some exposure to the agents for failing to make the disclosures and failing to obtain.
