Q: Is a dui charge in Ga an automatic reckless driving charge?
The citation I received the night of the charge did not have reckless driving printed on it anywhere. The court papers has reckless driving and dui as 2 separate charges
A: No, it is not. Two possible answers exist for this. (1) some police departments, particularly in MUNICIPAL Court locations, will issue BOTH tickets. This way, if a reduction of a DUI to a lesser charge is possible, then the prosecutor need not draw up an amended accusation. (2) Your driver was bad enough to justify the citation for driving in RECKLESS disregard, for persons or property, under OCGA 40-6-390.
