Q: I filed a chap.11 Bankruptcy in 2012 NYC, was converted to 7 in 2016. What date do I look at regarding the CPLR 5206 ?
I have extreme problems with my attorney. He is not to be trusted. He has repeatedly lied to me. The Judge in the case is aware of my situation also. I am filing with the NYS Grievance Committee as well. My so called attorney sends me false information, is erratic and abusive in behavior. I'm at the end of my Chapt. 7 case and have questions about money distributions starting with the Homestead Exemption ...CPLR 5206 and CPLR 5253...sold property in NYC closed August, 2017. I just want to know how much as an individual I will receive for the Homestead Exemption tax.
A: You will receive what you claimed as exempt in the case. Check your schedule C.
