Q: Is there even a case after my car accident ?
The driver of vehicle 1 (ours) was my boyfriend. I sat passenger and my daughter sat behind me. We were hit on the passenger side by a pick up truck speeding down the road. We were turning into a shopping complex. I was taken to the ER in the ambulance with my daughter. The report came back and claimed my bf was at fault for the accident because the other driver had the right of way. we planned on suing the insurance company for my back injuries and my daughters medical bills. The owner of the vehicle claims that the insurance was transfered to another car after the accident. She never reported it. and says we can't sue because the car wasn't covered. She also gave me a sob story about how her new home purchase could be in jeopardy if I sue and that the driver (my bf/her son) could be in trouble. It's a whole big mess leaving me with a back injury and my 6 yr old with anxiety about cars. what do I do? my stress level has rapidly increased off this situation.
A: You can sue the other driver but it seems like they may not be at fault thus here insurance would probably not have to pay anything. You can also sue your BF which seems like the better alternative because the accident was his fault according to your statement and collect from his insurance. I suggest you see a lawyer ASAP as you do have time limitations to sue.
A: You, your kids have claims. First, you get extensive medical benefits with no deductibles so make sure all get follow up. If the other driver has no insurance there is uninsured motorist coverage. Contact a member of the NJ Assn for Justice. If you need names let me know.
