Q: Me and my grandmother hit a hole crossing the railroad and it bust her transmission we were also hurt can we file suit

The van hit the tracks hard causing her to hit her face on wheel and my neck and back was hurting from the hit and made my body jerk which cause muscle strain can i file for pain and suffering

A: Anyone can sue for anything, but assumiong it's your standard humpbacked RR crossing, you know you have to take that very slowly. That being said, why not get a free consult from a member of the La. Trial Lawyers Assn---they give free ones.And see if your medical payment on your car insurance applies--up here in a similar situation, even if you couldn't sue the RR the injury was related to your using the vehicle so it would be a covered medical--dental too!
