Q: I just got a ticket for speeding 28 mph over the speed limit. With a clean record, will I get the full punishment?
A: Speeding 26-34 mph over the limit is a Class B misdemeanor. The maximum punishment is 6 months in jail and a $1,500 fine plus court costs. The maximum punishment is extremely unlikely, especially for a driver with a clean record. However, avoiding a criminal conviction and reducing the consequences is a top priority. You are strongly encouraged to seek legal representation.

A: This is a Class B Misdemeanor and you should hire an experienced criminal defense attorney to assist you with this matter. You do not want to go it alone.

A:
Hell Asker,
At 28 miles per hour, it would be placed in the 26 to 34 mile per hour bracket which is punishable as a Class B misdemeanor, up to six months in jail and or $1,500 fine. Both of these are very unlikely outcomes to occur. With that being said, Joliet is probably the harshest place in Illinois on these types of tickets. Depending on your last name, you can face judges who are more strict or less strict. The worst I can realistically expect to happen would be a weekend jail sentence and even that I think is unlikely given the speed unless it occurred on a relatively low speed zone. A much bigger concern is helping to prevent a misdemeanor conviction on your record which would give you a criminal record. My recommendation would be to speak to a lawyer and schedule a free consultation so that they can assess what options you have to help minimize the impact of this ticket. I don't foresee a maximum penalty happening unless you missed court in which case they may issue a bond forfeiture judgment for up to $1,500 but even in this circumstance they are very likely to vacate the judgement if you fix it by appearing. You would be best served by hiring an attorney to help leverage your clean record as grounds to help reduce the impact of this ticket.
I hope that helps and let us know if you have any questions!
Sincerely,
